1. Acceptance of Terms

By downloading, installing, or using the HeraKids application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legal agreement between you and HeraKids ("we," "our," or "us").

2. Eligibility

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account
  • The App is designed for use by parents/guardians with children aged 3-8
  • Children may only use the App under parental supervision
  • By creating a child profile, you represent that you are the parent or legal guardian of that child

3. Account Registration

To use HeraKids, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

4. Subscription and Payments

Pricing

HeraKids is available as a subscription service at $14.99/month. New users receive a 7-day free trial.

Billing

  • Subscriptions are billed monthly through the Apple App Store or Google Play Store
  • Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current period
  • Payment will be charged to your App Store or Play Store account at confirmation of purchase

Cancellation

  • You may cancel your subscription at any time through your device's app store settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds are provided for partial billing periods
  • Upon cancellation, you retain access until the end of your paid period

Free Trial

  • New users are eligible for a 7-day free trial
  • Only one free trial per household
  • If you do not cancel before the trial ends, your subscription will begin automatically

5. AI-Generated Content

HeraKids uses artificial intelligence to create personalized stories, audio narration, and interactive experiences. By using the App, you acknowledge that:

  • Content is generated by AI and may occasionally contain imperfections
  • We continuously monitor and improve AI output quality and safety
  • AI-generated stories are designed to be age-appropriate and educational
  • You may report any content concerns through the App's feedback feature
  • We do not guarantee that AI-generated content will meet every individual expectation

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Interfere with or disrupt the App's functionality or servers
  • Create multiple accounts to abuse free trial offers
  • Share your account credentials with others
  • Use automated systems to access the App
  • Attempt to circumvent any security features

7. Intellectual Property

  • The App, its design, features, and content are owned by HeraKids and protected by intellectual property laws
  • AI-generated stories created for your family are licensed to you for personal, non-commercial use
  • You may not reproduce, distribute, or commercially exploit any App content
  • The HeraKids name, logo, and branding are our trademarks

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We are committed to protecting the privacy of children and comply with COPPA and other applicable regulations.

9. Disclaimers

  • The App is provided "as is" and "as available" without warranties of any kind
  • We do not warrant that the App will be uninterrupted, error-free, or completely secure
  • HeraKids is not a substitute for parental guidance, education, or professional advice
  • We are not responsible for decisions made based on App content

10. Limitation of Liability

To the maximum extent permitted by law, HeraKids shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the App at any time. We will provide reasonable notice of material changes. Continued use after changes constitutes acceptance of the modified Terms.

12. Termination

We may terminate or suspend your account if you violate these Terms. Upon termination:

  • Your right to use the App ceases immediately
  • We may delete your account data in accordance with our Privacy Policy
  • Provisions that by their nature should survive termination will remain in effect

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which HeraKids operates, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration, except where prohibited by law.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Your continued use of the App after updated Terms are posted constitutes acceptance of the changes.
